Car Accident Advice: Someone hit me and doesn't want to go thru insurance?

Someone recently hit my car while it was parked across the street from my house. I almost thought it was a hit and run till I found their business card on my windsheild. I called her and she said she'd rather not go through her insurance but pay me directly for the damage to my car. I have been in accidents where I was hit but usually the other person just gives me their insurance info and I call them and get my car fixed fast, no problems. So I was already a little hesitant about agreeing to this, but I figured as long as it gets fixed it should be alright. So I did like she said and got an estimate from a body shop, then called her with it. Right off she said, Oh thats really high,(almost a 1000) and I reminded her that the damage is pretty severe, she backed into my rear passenger door, now entirely dented and scratched up. I know the estimate is fair compared to other work I 've had in the past. So anyways, I thought she'd decide right there like she had told me before, if it was affordable for her she'd pay me if not she'll go through her insurance. So since she acted like that was so much money I asked well does that mean you want to just use your insurance? She still sounded unsure and said she needs to figure this out. So it's been another day since that, still waiting, she did call again and say she's running it by her insurance agent to see which way would be better for her, insurance or pay me off. So I am still waiting, it's only been a few days since the accident but I am getting anxious because I kind of wish she would just give me her insurance info and go through it, my car would probably be in the shop already and this would be taken care of. But instead I 'm waiting for her. She still has not given me her insurance info, I don't have her license plate # or even what her car looks like, just a business card. And its a big inconvenience because I know I will be without a car for a at least 2-3 days, and even if she pays me she sure didn't mention a rental car. So my question is am I being too nice by waiting for her to decide whats best for her... and even if she wants to pay me should I have gotten her insurance info, like is that my legal right. So how long should I wait for her to decide?? Any advice would be greatly appreciated as obviously I should act fast. Thanks

This question came to mind as my husband attended the annual insurance meeting at his job. The premium is going up 2011, the deductible went up, he got a 5% cut in pay last month, has not had a raise in 3 years, took away overtime and shutting down a week every couple of weeks. As if we could not pay for insurance right now hardly, when he retires in a few years he will have at least medicare but I am 9 years younger and will have nothing. My boyfriend and I were at a stop light the light turned green. We started to go (this area is under contraction so the lanes are all messed up). The car in front of stops then hits their braks so did my boyfriend but it was to late we hit her. The car started to coast back and hit us again. Then we tryed to pull of to the side. We realized that it was a chain reaction. Car #1 was hit by car #2, car #3 hit car # 2 and we hit car #3 in that order. We did not launch all the cars together. Car #2 I'm sure will be going after the older woman in Car #3. The older woman said since it was likely the bumper would just buff out it was ok for my boyfriend to do that for her. But he said he would not touch the front of her car. (After talking to the insurace company they said my boyfriend fixxing it is a bad idea) My boyfriends car is the worse out of all of them it smashed in hood in, and broke the radatior brakets. (His car sat higher then hers and thats why it smashed it) The cop did try to write my boyfriend a ticket but the woman said it wasn't his fault the other cars hit before he hit Car #3. How will the insurance company handle this? What will happen to our car? We have Geico inusrance will no colistion insurance. I have never had a vilolation. My husband has. He had one in 2006 for running a red light and one in 2008 for driving too fast for conditions. Well naturally this has given me higher payments. My husbands pay was cut drastically at work so I was shopping around for cheaper insurance. I called Geico and they offered me liability for $55 a month. She came on and asked if I knew he had two tickets and at the time I didn't because I didn't know my husband in 2006. The lady told me my payments were going to be $144 with them and when I told her no she put me on hold. When she returned she offered me the $55. She read back to me everything I am getting which is a lot more than what I was getting from Liberty Mutual for a lot less price. The guy who hit me does not have an ample amount of insurance to cover my injuries. They are offering me the policy limits to settle. My own uninsured or uninsured motorist has been given enough documentation to know that my additional insurance will come into play. I have filed suit against the guy and his insurance company, but do I need a letter of consent to settle with them from my own insurance company to make sure that my uninsured motorist coverage will still be available to me. I really think it is criminal for any insurance company or state to make the limits on auto insurance so low, when the average cost of an auto accident is higher than the minimum coverages that they allow drivers to driver under. Also, there are many attorneys that wont even look at taking a case unless the limits are much higher than state minimum, because they can make considerably more on those who are very well insured. My own insurance company is treating my like I am retarded, and I was until I started reading all the insurance laws and bought a very fine civil litigation book for 4 dollars, best investment I ever made. But I am no Pro Se expert, my hat is tipped to you attorneys and insurance adjusters. What a stressful job you have and so many laws to abide by and to follow.
